Overview
These Terms of Engagement apply to medico-legal reports and expert witness work provided by Dr Andrew Baxter on behalf of Baxter Medico-Legal Ltd.
Instructions are accepted only once Baxter Medico-Legal Ltd has confirmed acceptance in writing.
Instructions
Instructions are accepted subject to availability, absence of conflict, and agreement of scope.
When acting as an expert witness, Dr Baxter's overriding duty is to the Court or Tribunal. Reports are prepared in accordance with applicable rules and guidance, including CPR Part 35 and associated Practice Directions where relevant.
Scope of work
The scope of work will be set out in the letter of instruction and confirmed before substantive work is undertaken.
Any additional questions, addenda, supplementary instructions, or further documentation may require additional time and fees.
Fees
Fees are provided on request and confirmed prior to acceptance of instruction.
Additional work, including conferences, joint discussions, addendum reports, responses to questions, and court-related work, may be charged separately unless otherwise agreed in writing.
Turnaround times
Estimated turnaround times are provided at the time of instruction and depend on bundle size, complexity, and existing commitments. Typically, reports are completed within six weeks.
Urgent work may be possible by prior agreement, but may be subject to an additional fee and is dependent on availability.
Conferences and court attendance
Attendance at conferences with counsel, joint discussions, and court can be arranged by separate agreement and subject to availability.
Cancellation
Reasonable cancellation charges may apply where work has already been undertaken or time has been reserved.
Payment terms
Invoices are payable in accordance with the agreed terms set out at the time of instruction.
Baxter Medico-Legal Ltd reserves the right to request payment in advance or to suspend work where agreed payment terms are not met.
Confidentiality and data protection
Personal data are processed in accordance with applicable UK data protection law.
Instructing parties are responsible for ensuring that disclosure is lawful and proportionate for the stated litigation purpose, and that sensitive material is transferred securely.
Governing law and jurisdiction
These terms are governed by the law of England and Wales. The parties submit to the jurisdiction of the courts of England and Wales.
Instruction-specific terms
Fees, availability, turnaround time, payment terms, and any instruction-specific terms will be confirmed in writing before acceptance of instruction.
